Finalmente a Chácara das Jaboticabeiras, área formada pelas ruas Benito Juarez, Cel. Artur Godoy e Dr. Fabrício Vampré, foi tombada! O pedido feito por um coletivo de vizinhos e pela AVM – Associação de Moradores da Vila Mariana, diante da emergente destruição que a nova Lei de Zoneamento pode provocar no pedaço, demorou cerca de 8 meses para sair.

O local abriga um sinuoso desenho urbano, fruto de dois loteamentos da década de 1920, que conserva três ruas de paralelepípedos quase centenárias, casas baixas, sobrados com quintais, vegetação exuberante — num único trecho de 200m há mais de 60 árvores. E duas praças, uma delas, a Arquimedes Silva, epicentro de uma das nascentes dos córregos que nutre os lagos do Ibirapuera: o Guariba.

Além de um batalhão de advogados contratados pelas construtoras, uma parte da vizinhança também foi contrária ao pedido. No entanto, o estudo técnico apresentado pelo relatório da arquiteta Maria Albertina Jorge Carvalho foi tão bem elaborado que não havia argumento para que a preservação não fosse aprovada. A própria diretora do DPH, Raquel Schenkman, lembrou aos conselheiros do DPH que a área foi objeto de interesse e indicação de proteção à época do Plano Diretor de 2014 e dos conselheiros participativos, na elaboração do Plano Regional.

Na última reunião, dia 9 de dezembro, a técnica do DPH apresentou o relatório confirmando o valor expresso requisitado pelos moradores e o tombamento da Chácara das jaboticabeiras foi acatado com o seu perímetro original. Contudo, foi marcada nova reunião no Conpresp, no dia 27 de janeiro, para dividir a área tombada em 3 setores, já que não houve consenso entre os conselheiros do órgão na ocasião, e ser estabelecidos os gabaritos, as normas, os recuos e os remembramentos dos lotes para cada 1 deles, além da permeabilidade. O que já foi firmado é que a área 1 não terá limite de gabarito, apenas com uma restrição ao recuo passando para 8m e as áreas 2 e 3 terá o gabarito de 10m e recuo de 4m. 

De qualquer forma foi uma vitória contra grandes incorporadoras interessadas em construir neste Eixo de Estruturação, onde a Lei de Zoneamento permite prédios altos de perder de vista.
